Terms of Service

Effective October 13, 2026 (version 2026-10-13.2). Northwoods Investment LLC, a New Hampshire limited liability company ("we", "us"), runs the Puddle Duck Finder web app, formerly called Marsh Finder (the "App"). By using the App or buying a subscription you agree to these terms.

Puddle Duck Finder checks a map against set criteria and shares waypoints where the habitat is most likely to offer a chance to see puddle ducks. It reads the land and water only, not whether animals are there today. A spot is not permission to hunt, fish, enter or cross any land.

The short version. The App reads habitat. It shows where marsh, flats and ponds suit puddle ducks, not whether birds are there or will be while you're there. It maps habitat, not property rights or legal access: a spot on the map is never permission to enter land or to hunt it. We never tell anyone to hunt, fish or go anywhere. You alone are responsible for confirming where you can legally go, for learning and following the laws, seasons and land rules wherever you go, and for identifying any animal before taking it. You can cancel anytime. Not for you? Get a full refund, no questions asked: within 7 days of your first payment on a monthly plan, or within 30 days on any other plan. One tap in your account. One refund per customer per app.

1. What the App is

The App is for anyone who wants to see puddle ducks, whether they hunt, watch birds or take photographs. Puddle Duck Finder checks a map against set criteria and shares waypoints where the habitat is most likely to offer a chance to see puddle ducks. It reads the land and water only, not whether animals are there today. A spot is not permission to hunt, fish, enter or cross any land. Suggested routes and parking are never permission to hunt or fish.

The App analyzes public wetland, land-cover, building, public-land and road data to estimate where puddle ducks are likely to feed and rest. It ranks those places and, on Pro, suggests how to reach the ones with a public way in.

The App does not detect, count or track birds. Whether ducks use a spot on a given day depends on things the App cannot see, including migration, weather, wind, tide, ice, food that year and hunting pressure. Results are estimates from data that can be out of date or imprecise (for example, wetland maps may predate recent changes to a marsh). We make no promise that you will see or take birds at any spot.

2. Laws, land rules, identification and safety

Your responsibility. When you create an account you confirm, by ticking a box, that you are responsible for learning and following the laws, seasons and land rules wherever you go, and for identifying any animal before taking it. Accounts made before October 12, 2026 are asked to tick the same box once. We keep the date and the version of these terms with your account. Rules differ by state: the App covers only the states it lists and never applies one state's rule in another. Where it doesn't have a state's rule confirmed, it tells you to check with that state's wildlife agency. Viewing may be allowed where hunting is not: check each piece of land's rules.

If you hunt, you are responsible for hunting legally and safely. Confirm who owns or controls any land or water you hunt, get permission or permits where required (many towns, especially on Long Island, require permits for bay bottoms and town wetlands), and follow all New York State Department of Environmental Conservation and federal migratory bird rules. New York law allows shooting a shotgun over water for waterfowl only when no house, building, livestock or person is within 500 feet in your line of fire; the App's building distances are estimates from public data and may miss structures. Suggested parking, walking lines and boat-access notes are guides from public data, not checked routes: roads may be gated, marsh may be soft or flooded, tides and cold water are dangerous, and lines may cross private land. Wear a life jacket on the water and use your own judgment.

Access disclaimer

Puddle Duck Finder maps habitat, not property rights or legal access. Parking and routes shown are limited to places listed as public in the sources named, which can be wrong or out of date. Public land can still close or restrict hunting, fishing or parking. Always respect private land: permission may be required to enter private land; get it where the law or the landowner requires it. Observe all federal, state and local laws, posted signs and regulations. You alone are responsible for confirming where you can legally go.

The App asks you to accept this disclaimer and these terms before your first spot search, and again whenever either changes. It shows the disclaimer again the first time you switch on spots on private land. We keep the date and time you accepted, and the versions you accepted, with your account (or, before you sign in, with this device).

How the App decides what to show: a spot counts as public only where a named source lists the land as public (in New York: NYS DEC or NYS Parks; in New Hampshire: NH GRANIT Conservation/Public Lands; in Vermont: Vermont Agency of Natural Resources lands; and, in all three, government land in USGS PAD-US), and each such spot names the source and the date of its data ("Public per [source], as of [date]"). Spots that are only partly on listed land, tidal marsh and bay bottoms that aren't listed (on Long Island many belong to the town trustees), and everything else are treated as private. Town and county land on Long Island, and public land with restricted access, are marked as needing a permit or residency and are treated like private land: they show only with spots on private land switched on, and never with a route, parking or directions. A route is shown only when every part of it is on public roads or land listed as public; parking only at lots listed as public by a state or federal agency (New Hampshire has no such list, so no parking is shown there), otherwise the App says "No listed public parking found". These listings are not a guarantee that land is open, that a lot has room, or that you may hunt there.

Private land

Pro can also list spots on private land, because many hunters own marsh or have permission to hunt land they don't own. They show only when you switch on "Show spots on private land" in the layers menu, which is off by default and off again each time you open the App. Spots whose land isn't listed as public, that need a permit, or that have no public way in (including public land that can only be reached across private land), are marked "Private Land ยท Permission may be required", with the banner "Private Land. Permission may be required. Respect land owners and local laws regarding accessing any property." They never show a route, parking, the nearest road, directions or Guide me. The App does not know who owns land, whether it is posted, or whether you have permission, and it never names owners. Land ownership and public-land boundaries come from public data and can be wrong or out of date. A spot, a mapped marsh or the Guide me arrow is never permission to enter land. Landowners who would rather their land not be shown can email us and we will remove the spots on it.

Boat launches and water routes. Launch locations come from listed public sources (NYS DEC's boat launch list and NYS Parks) and may be out of date, closed, fee-only, or limited to town residents. Water routes from a launch to a spot (Pro) are estimates drawn on mapped water. They are not navigation charts, and they don't account for tide height, depth, ice, current, dikes, gates, private docks or rules that close water to boats. Open-water crossings can be deadly in wind and cold water. Wear a life jacket, check the weather, and scout routes in daylight. You alone decide whether a crossing is safe.

4. Refunds

Not for you? Get a full refund, no questions asked: within 7 days of your first payment on a monthly plan, or within 30 days on any other plan. One tap in your account. One refund per customer per app.

The refund button is in the Account panel, with the last day you can use it. A refund returns your first payment in full, ends paid access immediately and moves your account to Free; your places, trails and bird log are kept. Renewal charges aren't refunded. The refund is available once per customer for Puddle Duck Finder (a refund in another Finder app doesn't use it up); after that, or after the window, email us and we'll treat your request fairly. Refunds normally appear on your card within 5 to 10 business days.

5. Your account

We identify you by the email you pay with. Sign-in links are personal; don't share them. You may use your subscription on your own devices. One subscription is for one person.

6. Acceptable use

Don't copy, scrape, resell or redistribute the App's maps, rankings or data; don't try to bypass the paywall; and don't interfere with the App's operation. We may suspend accounts that do.

7. Ownership

The App, its software, model, maps and rankings belong to Northwoods Investment LLC and are protected by copyright and other laws. Public source data remains subject to its own terms. Your places, trails and bird log stay yours (see the Privacy policy).

8. No warranty

The App is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and that the App will be uninterrupted or error-free.

9. Your responsibility, release and indemnity

You alone decide whether, when, where and how to travel, enter land, wade, boat, hunt or go onto ice, and you accept all risks of those activities and full responsibility for your decisions and their results, including any decision to enter or cross land or water, public or private, and whether you have permission to be there.

To the fullest extent the law allows, you release Northwoods Investment LLC and its members, managers, employees and contractors, and the people who designed and built the App (together, the "Puddle Duck Finder parties"), from any claim arising from those activities and decisions.

To the fullest extent the law allows, you agree to indemnify, defend and hold harmless the Puddle Duck Finder parties from and against all claims, demands, suits, losses, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) brought by anyone, including a landowner, another person or a government agency, that arise out of or relate to: (a) your entry onto, presence on, or use of any land or water, including trespass; (b) your hunting, travel, wading, boating or use of ice; (c) your breach of these terms, of any hunting or property law or regulation, or of a landowner's conditions; or (d) your use of the App. We may take part in the defense of any claim with our own counsel at our own cost. This section survives the end of your subscription or account.

Nothing in these terms limits liability that the law does not allow to be limited.

10. Limit of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for injury, drowning, vehicle damage, trespass, citations or losses arising from your hunting or travel decisions. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Changes

We may update these terms. If a change materially affects paying subscribers, we'll give notice in the App or by email before it takes effect. Continuing to use the App after that means you accept the change.

12. Law

These terms are governed by the laws of the State of New Hampshire. Any dispute will be handled in the state or federal courts located in New Hampshire, unless the law where you live gives you the right to bring it elsewhere.
